Privacy Policy
Gotaru Inc. (the "Company") establishes this Privacy Policy (the "Policy") regarding the handling of privacy information in the smartphone application "Michimieru" (the "App").
Article 1 (Privacy Information)
- Among privacy information, "personal information" means personal information as defined by the Act on the Protection of Personal Information of Japan. It refers to information about a living individual that can identify a specific individual by name, date of birth, address, telephone number, contact information, or other descriptions contained in such information.
- "History information and characteristic information" means information other than the personal information defined above, including services used, pages viewed, search keywords, date and time of use, method of use, usage environment, postal code, gender, occupation, age, IP address, cookie information, location information, and device identifiers.
Article 2 (How Privacy Information Is Collected)
- The Company may ask users for personal information such as email address and display name when they register. The Company may also collect transaction records and payment-related information containing users' personal information from partners, including information providers, advertisers, and ad distributors.
- When users use the App, the Company collects history and characteristic information such as services used, page browsing history, search keywords, date and time of use, usage method, usage environment, IP address, cookie information, location information, device identifiers, and image data captured by the camera for the traffic counting feature.
- The App uses the device camera with the user's consent in order to provide the traffic counting feature. Captured image data is analyzed in real time and used to count traffic. Image data may be stored only when necessary to improve service quality or functions and only with the user's consent. Stored image data is managed with appropriate security measures and deleted promptly after its purpose has been fulfilled.
Article 3 (Purposes of Collecting and Using Personal Information)
The purposes for which the Company collects and uses personal information are as follows.
- To allow users to view and modify their registration information and usage status by displaying email addresses, display names, registration information, services used, and related information.
- To use email addresses for notices and communications to users.
- To use email addresses, authentication information, and other information to verify users' identities.
- To display information registered with the Company on input screens or transfer it to other services, including partner services, based on user instructions so that users can enter data conveniently.
- To refuse use by users who violate the App's Terms of Service or attempt to use the service for fraudulent or improper purposes, by using usage patterns, email addresses, and other information that can identify individuals.
- To respond to inquiries from users by using inquiry details, information necessary for providing services, usage status, and contact information.
- To analyze image data captured by the camera and generate traffic data for the traffic counting feature.
- To create and analyze statistical data for service quality improvement and new feature development.
- Purposes incidental to the above purposes.
Article 4 (Provision of Personal Information to Third Parties)
Except in the following cases, the Company will not provide personal information to third parties without obtaining the user's prior consent, except as permitted by the Act on the Protection of Personal Information or other laws and regulations.
- When required by law.
- When necessary to protect a person's life, body, or property and it is difficult to obtain the person's consent.
- When especially necessary for improving public health or promoting the sound growth of children and it is difficult to obtain the person's consent.
- When cooperation is necessary for a national government agency, local public body, or a person entrusted by them to perform legally prescribed duties, and obtaining consent may hinder the performance of those duties.
- When the following matters have been announced or made public in advance.
- That the purpose of use includes provision to third parties.
- The items of data provided to third parties.
- The means or method of provision to third parties.
- That provision of personal information to third parties will be stopped at the request of the person.
Notwithstanding the preceding paragraph, the following cases do not constitute provision to third parties.
- When the Company entrusts all or part of the handling of personal information within the scope necessary to achieve the purpose of use.
- When personal information is provided as a result of business succession due to merger or other reasons.
- When personal information is jointly used with a specific party and the person has been notified in advance, or can easily know, the items of personal information jointly used, the scope of joint users, the purpose of use by users, and the name or title of the person responsible for managing the personal information.
Article 5 (Disclosure of Personal Information)
When the Company is requested by the person to disclose personal information, the Company will disclose it to the person without delay. However, the Company may decide not to disclose all or part of the information if disclosure would fall under any of the following cases, and will notify the person without delay if it decides not to disclose it.
- When disclosure may harm the life, body, property, or other rights or interests of the person or a third party.
- When disclosure may significantly interfere with the proper implementation of the Company's business.
- When disclosure would otherwise violate laws or regulations.
Notwithstanding the preceding paragraph, the Company generally does not disclose information other than personal information, such as history information and characteristic information.
Article 6 (Correction and Deletion of Personal Information)
- If the user's personal information held by the Company is incorrect, the user may request correction or deletion of the personal information through procedures specified by the Company.
- If the Company determines that it is necessary to respond to the request described in the preceding paragraph, the Company will correct or delete the personal information without delay and notify the user.
Article 7 (Suspension of Use, etc. of Personal Information)
If the person requests suspension of use or deletion of personal information ("Suspension of Use, etc.") on the grounds that the personal information is handled beyond the scope of the purpose of use or was obtained by improper means, the Company will conduct the necessary investigation without delay and, based on the results, suspend use or otherwise take appropriate action and notify the person. However, if Suspension of Use, etc. would require excessive cost or is otherwise difficult, and alternative measures necessary to protect the person's rights and interests can be taken, the Company will take such alternative measures.
Article 8 (Changes to the Privacy Policy)
- The contents of this Policy may be changed without notice to users.
- Unless otherwise specified by the Company, the revised Privacy Policy will take effect when posted on this website.
